Official Rules

  1. Organizer The organizer of the “Golden Square Mile Greatness Escapades” contest (the “ Competition”) is the Golden Square Mile Tourism Development Society, also known as the Golden Square Mile TDS (hereinafter “ the Organizer”) , a non-profit legal person having its head office at 1195 Sherbrooke West street, located in the city of Montreal, province of Quebec, H3A1H9.
  2. Eligibility. Only participants of the age of majority in their country or province of residence at the time of their participation are eligible to participate to the Contest. The Organizer, its subcontractors, its agents, or its representatives involved in the organization of the Competition as well as their employees and anyone domiciled at the same address, as the persons mentioned above cannot participate to the Contest. Advertising and promotional agencies as well as any other person engaged in the development, production or distribution of material relating to this Contest are considered subcontractors of the Organizer. For the purposes of the Contest, the Organizer may at any time require proof of identity or eligibility of any person participating in the Contest (the “ Participant”). The Participant who does not provide proof within five (5) days of such a request from the Organizer may be disqualified, at the sole discretion of the Organizer. All information and documentary evidence in support of the information provided to the Organizer by the Participant must be valid, accurate and complete. The Organizer has the right to disqualify any Participant whose participation is received outside the Contest period (as that term is defined below), which contains false, fictitious, inaccurate or incomplete information.
  3. Timeline. The Contest begins on November 18, 2021 at 8:00 am Eastern Time (“ ET ”) and ends on December 26, 2021 at 11:59 am ET (the “ Contest period ”). Any receipts/participation submitted to, or received by, the Organizer after the Contest ends, regardless of the submitting method used, will be void and deemed to be made outside the Contest périod. The contest draw will take place on December 29, 2021 at 3:00 p.m. in Montreal. Participants-winners will be contacted immediately by email and will have until January 15, 2022 6:00 p.m. to claim the winning prizes. From January 15, 2022, after 6:01 p.m., unclaimed prizes will not be awarded. The servers used to receive online entries serve as the official timekeeper for the purposes of the Contest.
  4. Rules Acceptance. By entering the Contest, Participant agrees to be fully and unconditionally bound by these Official Contest Rules (the “ Rules”) and represents and warrants that he or she meets the eligibility requirements set forth herein. ANY BREACH OF THESE RULES OR TERMS OF USE BY ANY PARTICIPANT WILL RESULT IN ITS DISQUALIFICATION AND ANY PRIVILEGES (INCLUDING THOSE AS WINNER, IF APPLICABLE) WILL BE IMMEDIATELY REVOCATED AND CANCELED. Subject to the prior approval of the Régie des Alcools, des Courses et des Jeux when required, the Participant agrees to accept all decisions of the Organizer as being final and binding with regard to all matters related to the Contest. This provision does not have the effect of allowing the Organizer to decide unilaterally that the Participant has breached one or other of its obligations or that a fact or situation has occurred.
  5. How to participate. No purchase is necessary to participate to the Contest.
    1. Online subscription. To subscribe to the Contest online, the Participant must, during the Contest period, register online at goldenmontreal.ca/contest, complete all mandatory fields of the participation form and click on the “submit” button. His registration will then be deemed admissible. Only one participation is eligible for the contest per participant, unless a purchase receipt is submitted. To do so, the participant must purchase goods or services (an “ Eligible Purchase ”) during the Contest period from a business or institution located within the perimeter of the Golden Square Mile district in downtown Montreal delimited by René-Levesque Boulevard to the south, Guy Street to the west, Pine Avenue to the north and Robert-Bourassa Boulevard to the East.       The Participant must keep the invoice for the Eligible Purchase (the “ Invoice”) allowing him to be eligible for additional participation to the contest and use a device that can access the Internet to access the Contest page, either (the “ Page”). Once on the page, the participant who choses the online subscription form (the ” Participant in line “) must complete the subscription form in which he provides the information to identify, valid email address, the the purchase amount (excluding taxes and service), as well as a picture of the receipt/invoice (the “ aphie de la Facture détaillée (le « Form”). Upon request, the Participant must send the original of the Invoice relating to the Eligible Purchase to the Organizer by mail. Each Invoice submitted provides only one additional eligible participation to the contest. There is no limit to the number of additional entries in the eligible contest with Purchase insofar as each Invoice is different. The same Invoice can only be submitted by one contest participant.
    2. Participation without purchase. To participate in the Contest, the Participant must send a letter to the Organizer including : the Participant’s name, address, postal code, telephone number and email address (the “ Letter”). This Letter must also contain a handwritten and original fifty to one hundred word statement explaining why the Participant enjoys shopping in the Golden Square Mile district. This Letter must be received by the Organizer before the End of the Contest. This alternative method of participation cannot be used by a Participant who has participated in the online participation mode. The Participant who chooses the mode of participation without purchase (the “ Participant without purchase”) can send only one Letter. Any attempt by a Participant to obtain more than the maximum number of entries by using multiple or different identities, using more than one participation method, submitting an Invoice already submitted, submitting more than one Letters, or using any other method, will void all entries by that Contest Participant and that Participant will be disqualified. If the information on the Form differs from that on the Invoice, then the Participant’s participation will be rejected. It is not possible to appoint an agent for the purposes of this Contest. The use of any automated system whatsoever to participate in the Contest is prohibited and will result in disqualification of the Participant. Anyone manipulating the participation process or the holding of the Contest, or acting in violation of the Rules of this Contest or any other promotion, or acting in an unfair or disruptive manner will be disqualified from the Contest. If a disqualified Participant wins a Prize, he will lose the right to claim the prize and be awarded the Prize. Unless this arises from the act of the Organizer or its representative, neither the Organizer, nor any of its subsidiaries, nor any of their representatives will be responsible for an participation that is lost, received not on time, incomplete, invalid, unintelligible or sent to the wrong address/ platform, which will be disqualified.

  7. Draw.
    1. The probability of winning a Prize is equal for each eligible participation submitted and materializes when the Participant submits their participation Form or letter of participation. The draws end immediately, without notice or notification, when the winner has been identified in accordance with these rules.
  8. Awarding of Prizes. Following the selection of a participation :
    1. The Organizer verifies the compliance of the participation, including Qualified Purchase and the Invoice, within a maximum of (24) hours after the draw. In the event that the winning Participant’s form does not allow him to qualify for the Contest or if the latter does not respond to the Organizer’s email advising him of his Prize before January 15, 6:00 p.m., the unclaimed prizes will not be not assigned .
  9. Awards. Once a Participant has been declared the winning Participant, the Organizer will send him an email to the email address provided by the Participant.
  10. Refusal of the prize. The selected Participant must accept the Prize as described in these Rules or the substitution prize of equal or greater value determined by the Organizer in its sole discretion. The selected Participant may not demand that the Prize be transferred to another person, substituted for another Prize or other goods or services, or exchanged in whole or in part for a sum of money or any other form of compensation. The refusal of a Participant to accept a Prize in whole or in part releases the Organizer from any obligation related to the attribution of this Prize or this part of the Prize to this Participant or to any other Participant.
  11. General clauses. The Contest is subject to all applicable federal, provincial, municipal and local laws and regulations and is void where prohibited by law. The Organizer reserves the right, with the authorization of the Régie des alcools, des courses et des jeux or any other governmental authority having jurisdiction, when required, to cancel, suspend and / or modify the Contest or the Rules, or any part thereof, for a case of force majeure, if fraud, technical failure, human error or any other circumstance jeopardizes the fairness, integrity or proper functioning of the Contest, if the Contest may not proceed in the manner originally intended or if it is necessary to do so in order to ensure their compliance with applicable federal, provincial or municipal laws and regulations or with the policies of an entity having jurisdiction over the Contest, the Organizer, the Contest or the Rules. Without limiting the foregoing, any participation that occurs after the system fails for any reason is deemed to be an ineligible participation, is void, and will not be eligible for any Prize. The Organizer will not be held responsible if an event results in the cancellation of the Contest or if other factors over which the Organizer cannot reasonably exercise control prevent the Contest from being completed, in whole or in part. Any attempt by any person to deliberately compromise the legitimate functioning of the Contest may constitute an offense under civil or criminal law, and in the event of such an attempt, the Organizer reserves the right to claim damages from such person to the full extent permitted by law. The Organizer’s failure to enforce a term of these Rules does not constitute a waiver of this provision.
  12. Disclaimer of Liability. By participating in the Contest, the Participant : i) agrees to exonerate the Organizer, its affiliated companies, as well as their suppliers, their distributors, their respective advertising or promotion agencies as well as each of their officers, administrators. , employees and agents (collectively, the ” Released Parties “) with respect to any claim or cause of action, including, but not limited to, personal injury, death, damage to property or its property. destruction resulting directly or indirectly from participation in the Contest, or from the receipt, or use, or misuse of a Prize, unless it is a consequence of the Organizer or its representatives; and ii) promises to fully compensate the Released Parties for any claims made by third parties as a result of the Participant’s participation in this Contest, including, but not limited to, those arising from a fault of the Participant.
  13. Liability limitations. Unless it is a consequence of the fact of the Organizer or its representative, the Released Parties will not be liable for : i) any incorrect or inaccurate information, whether attributable to the Participant, to errors in printing, equipment or software programming associated with or used in connection with the Contest; ii) technical problems of any kind including, but not limited to, malfunction, interruptions or disconnections of telephone lines, electronic hardware or software; iii) unauthorized human intervention in any part of the participation process or the Contest; iv) technical or human errors that may occur in the administration of the Contest or the processing of entries; v) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, by the participation of the Contestant in the Contest or in connection with the receipt or use of a Prize.
  14. Non-involvement of the Organizer’s partner organizations. The Contest is not, approved, managed or administered by public bodies or with public funds, whether or not they have partially funded the organization of the Contest. The Participant releases these organizations from any liability of any kind whatsoever in connection with the Competition.
  15. Disputes. Any dispute, regarding the organization or conduct of a publicity contest, may be submitted to the Régie des alcools, des courses et des jeux for validation. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Subject to the foregoing paragraph, Participant agrees as follows : i) any dispute, claim and cause of action arising out of or relating to this Contest or the awarding of any Prize shall be resolved by the courts of the province of Quebec, judicial district of Montreal; ii) any claim, judgment and conviction must be limited to the reimbursable costs actually incurred, including costs associated only with participation in the Competition, but not including in any case legal fees or the Amount of costs on an Invoice. ; and iii) le Participant ne pourra, en aucune circonstance, obtenir une condamnation pour dommages indirects, incidents ou consécutifs ou tout autre dommage autre que pour ses frais remboursables réellement engagés, et il renonce par les présentes à tous ses droits de réclamer de tels dommages, et à tout droit de multiplier ou d’accroître les dommages de toute autre manière.
  16. Applicable law. The validity, interpretation and enforceability of these Rules or the rights and obligations of the Participant and the Organizer in relation to the Contest are governed by the laws of the province of Quebec and the federal laws of Canada applicable therein and interpreted in accordance with these, without giving effect to any rule relating to conflicts of laws (whether it be the laws of the province of Quebec or any other jurisdiction), which would result in the application of the laws of any other jurisdiction .
  17. Divisibility. If any provision of these Rules is declared invalid or unenforceable, all remaining provisions of the Rules will remain in full force.
  18. Participant’s personal information. By entering the Contest, the Participant allows the Organizer to use the personal information he provides for the purposes of administering the Contest and awarding the Prizes. The information provided in the participation form will be used for the purposes of the Contest. If the Participant has checked the box in the participation form indicating that he wishes to receive promotions and communications from the Organizer and its partners, the Organizer and its partners will thus have the authorization to communicate with the Participant. by email.
  19. Winners list. The list of winners will be sent by request from info@goldenmontreal.ca within thirty (30) days after the End of the Contest.
  20. Advertising . Participation in the Contest constitutes the Participant’s consent to the use, by the Organizer and its agents, of their name, image, photograph, voice, opinions and / or city of residence for promotional purposes in any medium, worldwide, without payment or additional consideration, whether or not it has won an award, unless prohibited by law.
  21. Social media. The Participant acknowledges that the Contest is in not sponsored, , approved, managed or administered by the owner of any social media or other site (the “ Owner”) on which he may have seen an advertisement relating to the Contest, nor is associated in any way with the Owner. The Participant releases the Owner from any liability of any kind whatsoever in connection with the Contest.
  22. Participation and License ownership. By participating in the Contest, the Participant accepts that his participation becomes the Organizer’s porperty and that the Participant’s contribution is not necessarily recognized by the Organizer. By entering the Contest, each Participant grants the Organizer a worldwide, non-exclusive, perpetual, irrevocable, royalty-free license to publish, adapt, modify, perform derivative works and / or otherwise use the participation in any way, including copyright, for any media currently known or developed later. In addition, by participating in the Contest, the Participant waives all moral rights that he may have in his participation, all in favor of the Organizer.
  23. Organizer Intellectual property. All intellectual property and promotional material, websites in the image of the Organizer or the Contest and the source codes are the property of the Organizer and the entities related to it.   25. In the event of incompatibility between the English and French versions of these Rules, the French version will prevail. In the event of an incompatibility between a version of these Rules and the version available at the place provided for in paragraph 25, the Rules accessible at the place provided for in paragraph 25 shall prevail.
